TERMS OF SERVICE
These Terms of Service ("Terms") are a legal agreement between you and TEKRISE ("we", "us", "our") governing your use of the TEKRISE app and website. Please read them carefully. By creating an account or using TEKRISE, you agree to these Terms and to our Privacy Policy.
01 Eligibility & Age
You must be at least 13 years old to use TEKRISE. If you are in the European Economic Area or the United Kingdom, you must be at least 16 (or the minimum age of digital consent in your country, if higher). By using TEKRISE you confirm you meet this requirement.
TEKRISE is a general-audience service and is not directed to children under 13. We do not ask for your date of birth. If we learn that someone under the required age is using TEKRISE, we may suspend or delete the account.
02 The Service
TEKRISE lets you record or upload a short tennis swing, analyses it on your device and on our servers, and uses AI to generate coaching feedback. Features, limits, and availability may change, and we may add, modify, or discontinue parts of the service at any time. The app is available on Android and iOS.
03 Your Account
- You are responsible for the information you provide and for keeping your account secure.
- Provide accurate information and keep it up to date. You can edit your profile in the app.
- You are responsible for activity that happens under your account. Tell us promptly if you suspect unauthorised use.
You can start using TEKRISE as a guest, without giving us an email address. A guest session is tied to the device you created it on. Add an email address or link a Google or Apple account to keep your history — if you reinstall the app, switch devices, or clear the app's data, an unconverted guest account and its analyses may not be recoverable. Converting keeps everything you have already done.
04 Your Content & Consent
You keep ownership of the videos and content you create ("Your Content"). To run the service, you grant us a limited, worldwide, non-exclusive licence to host, process, and analyse Your Content (and the data derived from it) solely to provide and improve TEKRISE for you, as described in our Privacy Policy.
You confirm you have the right to upload Your Content and the permission of anyone who appears in it. If a video includes a minor, you confirm you are their parent or legal guardian, or that you have the consent of their parent or guardian. Do not upload content you do not have the rights or consent to share.
TEKRISE is not a backup service. We may delete the short clip stored for an analysis once that analysis is outside your 100 most recent or more than 12 months old, whichever comes first. We may keep a clip for longer than that, but you should not rely on it. Your coaching results, scores and progress history are kept and are not affected — only the video is removed.
Guest accounts. If you use TEKRISE without creating an account, your clips and analyses may be deleted after 12 months of inactivity, and cannot be recovered if you lose the device or clear the app's data. Create an account to keep your history.
Your full original recordings stay on your phone and are never uploaded, so you always hold the master copy. Please keep any clip that matters to you.
Sharing a swing card. The app can create a shareable image of one of your swings. When you share that image to another app or service, you are publishing it yourself, outside TEKRISE, and what happens to it afterwards is governed by that other service — not by these Terms. Only share a card if you are happy for the people who see it to see your swing.
05 AI Feedback — Informational Only
TEKRISE's scores and coaching feedback are generated by automated analysis and AI models. They are provided for general informational and training purposes, may be incomplete or inaccurate, and are not a substitute for a qualified tennis coach or for professional, medical, or other advice. You are responsible for how you use the feedback.
06 Health & Safety
Tennis and physical training carry inherent risks of injury. TEKRISE does not provide medical advice. Consult a qualified professional before starting or changing any training, warm up properly, and stop if you feel pain. You use the app and act on its suggestions at your own risk.
07 Coaches & Community
TEKRISE includes optional features that let you connect with a human coach, share individual swings with them, and receive written feedback. Coaches can list themselves so other players can find them, and students can leave a rating and a short review.
Any coaching relationship is between you and that coach. TEKRISE does not verify anyone's qualifications, experience, insurance, or background; does not employ, supervise, or direct coaches; does not endorse or recommend any coach; and is not responsible for the advice a coach gives you or for anything that happens between you. Coach badges and rankings reflect activity in the app, not competence. Use your own judgement, exactly as you would when choosing a coach anywhere else.
- No payments through TEKRISE. We do not process payments between students and coaches, take commission, or become party to any arrangement you make with a coach. Anything you agree with a coach outside the app is your own arrangement.
- You control what is shared. A coach only sees the swings you explicitly share with them. You can stop sharing a swing, or end the connection, at any time — and so can they.
- Content you write about others. Coach bios, ratings, reviews, and coaching feedback must be honest, your own, and lawful. Do not post abuse, harassment, threats, discriminatory content, or anything false or misleading. Do not post other people's private information. Do not post reviews you were paid or pressured to write, or reviews of yourself.
- Report a problem. If a coach, student, review, or piece of feedback breaks these rules, contact us with the details and we will look into it. We may remove content, hide a listing, or suspend or terminate an account. In the app you can also end any connection immediately.
We host this content but do not endorse it, and we do not routinely review it before it appears. Opinions in reviews and coaching feedback are those of the people who wrote them.
08 Acceptable Use
You agree not to:
- Upload content you do not have the rights or consent to share, or that is unlawful or infringes others' rights.
- Upload content of a person under the required age without being their parent/guardian or having that consent.
- Harass, abuse, threaten, or impersonate a coach, a student, or anyone else, or use the coaching features to contact someone who has ended a connection with you.
- Post false, paid-for, or malicious ratings or reviews, or otherwise manipulate coach ratings and rankings.
- Misuse, probe, overload, or attempt to circumvent the security, quotas, or paid features of the service.
- Reverse-engineer, scrape, or use the service to build a competing product, except as permitted by law.
- Use the service for any unlawful, harmful, or abusive purpose.
09 Subscriptions, Ads & Purchases
- TEKRISE is free to start. Some features require a paid subscription, sold and billed through the Apple App Store or Google Play and managed via RevenueCat. The plan name, length, and price per period are shown in the app before you purchase.
- Subscriptions renew automatically for the same period at the same price unless you cancel. Your account is charged within the 24 hours before the current period ends. You can cancel at any time in your app store account settings — cancelling takes effect at the end of the period you have already paid for, and you keep access until then. Deleting the app does not cancel a subscription.
- Where an introductory or trial offer applies, its length and price are shown before purchase; eligibility is determined by the app store, and the subscription continues at the standard price afterwards unless cancelled.
- Billing and refunds are handled by the app store and are subject to its policies. We cannot issue refunds on the app store's behalf.
- Usage limits ("quotas") apply to analyses and may change. Free-tier access to certain features may require watching a rewarded ad.
10 Apple App Store
If you downloaded the app from the Apple App Store, the following applies:
- These Terms are between you and TEKRISE only, not with Apple, and Apple is not responsible for the app or its content.
- Apple has no obligation to provide any maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
- Apple is not responsible for addressing any claim by you or a third party relating to the app, including product-liability claims, claims that the app fails to conform to a legal requirement, and claims under consumer-protection or similar legislation.
- Apple is not responsible for investigating, defending, settling, or discharging any third-party claim that the app infringes intellectual-property rights.
- You confirm you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce them against you.
11 Intellectual Property & Copyright
The TEKRISE app, website, branding, and software are owned by us or our licensors and are protected by intellectual-property laws. We grant you a personal, non-transferable, revocable licence to use the app for its intended purpose. These Terms do not transfer any of our intellectual-property rights to you.
Copyright complaints. We respect the intellectual-property rights of others. If you believe content on TEKRISE infringes your copyright, contact us with: enough detail to identify the work, where the content is in our service, your contact details, a statement that you believe in good faith the use is not authorised, a statement that the information is accurate and that you are the rights holder or authorised to act for them, and your signature (electronic is fine). We will investigate and may remove the content and, where appropriate, terminate repeat infringers' accounts.
12 Termination
You may stop using TEKRISE at any time, and you can ask us to delete your account by following Delete your account. We may suspend or terminate your access if you breach these Terms, or to protect the service or other users.
When your account ends, your coach connections end with it and any swings you had shared stop being accessible to those coaches. Your profile, uploaded clips, and analysis history are deleted; some operational and security records are kept, as described in our Privacy Policy. Recordings stored on your own device are not affected and remain yours to delete. Provisions that by their nature should survive termination (such as licences you grant, disclaimers, and limitations of liability) will survive.
13 Disclaimers
The service is provided "as is" and "as available", without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the service will be uninterrupted, error-free, or that the analysis or AI feedback will be accurate or fit for any particular purpose.
14 Limitation of Liability
To the maximum extent permitted by law, TEKRISE and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of (or inability to use) the service, your reliance on its feedback, or your dealings with any coach or other user. Nothing in these Terms excludes or limits rights that cannot be excluded under applicable law, including consumer-protection rights such as those under the Australian Consumer Law.
15 General
- Entire agreement. These Terms and our Privacy Policy are the whole agreement between you and us about the service, and replace any earlier understanding about it.
- Severability. If any part of these Terms is found unenforceable, the rest stays in force and that part is applied as closely as possible to its intent.
- No waiver. If we do not enforce a right straight away, that does not mean we give it up.
- Assignment. You may not transfer your rights under these Terms without our consent. We may transfer ours to a successor, for example if the project is acquired, provided your rights are not reduced.
16 Changes to These Terms
We may update these Terms from time to time. When we make a material change, we will update the version and effective date above and, where appropriate, ask you to accept the updated Terms in the app before you continue using it. Your continued use after an update means you accept the revised Terms.
17 Governing Law
These Terms are governed by the laws of Australia, without regard to conflict-of-laws rules, and you agree to the non-exclusive jurisdiction of the courts located there. This does not deprive you of any mandatory consumer protections of the country where you live.
